Welcome to PayMongo Payments! Please read these Terms of Use (Terms) prior to completing the registration for a virtual account with PayMongo. The following Terms shall govern the terms under which you may access and use your virtual account on the PayMongo website and the services associated with it (together, “PayMongo Services.”) By registering to PayMongo or using your PayMongo virtual account, you accept and agree to be legally bound by these Terms.
Please also read our Privacy Policy and Acceptable Use Policy before you use any portion of the PayMongo Service. The Privacy Policy describes how your personal data is collected and processed when you use the PayMongo Service. The Acceptable Use Policy defines the set of rules that you should comply with when using your virtual account. If you do not understand or do not wish to be bound by the Terms and/or Privacy Policy, you should not access or use any portion of the PayMongo Service.
The Terms shall be effective, valid and binding from the time you agreed to it and will exist up to the time that it is terminated by you or us, save for those provisions that will remain effective after termination as stated in the Terms, laws or regulations.
PayMongo reserves the right to modify these Terms at any time without any advance notice. Any changes to these Terms will be effective immediately upon posting on this page, with an updated effective date. By accessing or using the PayMongo Service after any changes have been made, you signify your agreement on a prospective basis to the modified TOU and all the changes. Be sure to turn to this page periodically to ensure familiarity with most current version of the Terms.
Any version of these Terms in a language other than English is provided for convenience and you understand and agree that the English language version will control if there is any conflict.
Under these Terms, the terms “PayMongo”, “we”, “us”, and “our” refer to PayMongo Payments, Inc. together with its employees, directors, affiliates, successor and assigns. PayMongo Payments is duly registered with and licensed by the Bangko Sentral ng Pilipinas (BSP).
1.1 If you are a business owner, you represent that you are at least eighteen (18) years of age or above.
1.2 If you are signing on behalf of a business entity, you also represent that you are duly authorized to do business and your employees, officers, representative and other agents accessing or using the PayMongo Service are duly authorized to access and use the PayMongo Service and to legally bind you to these Terms and all transactions conducted under your PayMongo account.
2.1 When you accept these Terms, you are setting up your PayMongo Virtual Account that is associated with your PayMongo Merchant Account. You will be asked to provide information such as your complete name, present and/or permanent address, date of birth, nationality, source of funds, photo of yourself and signature in accordance with the Know-Your-Customer (“KYC”) requirements of the BSP. We may verify your registration information through a third-party verification vendor, as we may deem necessary. In some cases, we may ask you to provide additional details or information that can aid in verifying your identity.
2.2 You agree to provide all necessary information and render all reasonable assistance and cooperation that we may require in order to complete the verification. The information you provide will be used to determine if you are eligible to begin and/or continue to use your PayMongo Virtual Account. We reserve the right to close, suspend or limit your access to your PayMongo Virtual Account in the event that we are unable to obtain or verify our information. All collection and use of your personal data by us is subject to the Privacy Policy of PayMongo.
2.3 You are responsible for providing accurate registration information and for keeping your registration information up to date, or notifying us in the event of changes. In addition, as certain PayMongo Services may become available or be offered only on selective basis or promotional basis, supplementary information may be required from your end in order to enable the relevant PayMongo Services or open a PayMongo Virtual Account.
Definitions appearing in these Terms shall have the meanings ascribed to them below.
PAYMONGO E-MONEY shall refer to a form of electronic money which allows customers who registered to PayMongo Service to easily and conveniently send and receive their payouts as well as transfer to other bank accounts or e-wallets.
“PayMongo Service” shall refer to the PayMongo Services available on the PayMongo website, where the PayMongo merchant can avail of the PayMongo Service or make use of the PayMongo Virtual Account.
“PayMongo Virtual Account” shall refer to the e-money instrument that stores Philippine Peso (Php) value which resides in the PayMongo system. It is an account that is linked to the user’s PayMongo Merchant account. Functionalities include, but are not limited to, receiving merchant payouts, transfer of funds, and balance inquiry.
“PayMongo Virtual Account Holder” shall refer to a business owner or registered business entity who registers for a PayMongo Virtual Account in order to receive his or her payouts from using PayMongo’s payment facilitation services.
“Know Your Customer” or “KYC” shall refer to the process of establishing the identity of a business owner or registered business entity applying for the opening of a PayMongo Virtual Account, as required by the BSP, also known as Customer Verification.
The PayMongo Virtual Account is a reloadable e-money instrument. It is not a deposit account, and not covered by the Philippine Deposit Insurance Corporation (PDIC). It does not earn interest. However, it is subject to the rules and regulations of the BSP, the Anti Money Laundering Act (AMLA), as amended and the Data Privacy Act of 2012 and its Implementing Rules and Regulations. The value loaded in your PayMongo Virtual Account may be used to transfer money to other bank or e-wallet accounts.
Transaction and Virtual Account balance limits may be assigned or changed by PayMongo at its option pursuant to applicable laws, subject to fifteen (15) days prior notice to the PayMongo Customers.
The PayMongo Virtual Account Holder Customer agrees to pay other fees and charges related to his/ her transfers out of the PayMongo Virtual Account, as may be applicable. The said transfers shall be inclusive of all applicable Philippine taxes and shall be debited from the PayMongo Virtual Account or paid up front.
Charging of dormancy maintenance fees shall apply to PayMongo Virtual Accounts that have not been used for any monetary transaction for at least six (6) months from the last date of transaction.
The transaction history of the PayMongo Virtual Account Holder is accessible to the holder by logging into his or her PayMongo Merchant Dashboard, via the PayMongo website. The PayMongo Virtual Account Holder may also download and print the said transaction history from the same Dashboard.
The entries in the PayMongo Virtual Account transaction history are presumed true and correct unless the PayMongo Virtual Account Holder notifies PayMongo Payments, Inc. in writing of any disputes thereon within fifteen (15) days from the date of transaction. If no dispute is reported within the said period, all transactions and the entries in the Account/ Transaction History on the Dashboard are considered conclusively true and correct.
Disputed transactions shall only be credited back to PayMongo Virtual Account Holder’s balance once the claim/ dispute has been properly processed, investigated, and proven to be in favor of the PayMongo Virtual Account Holder.
PayMongo makes no warranty, express or implied, regarding the PayMongo Service.
The PayMongo Service is offered on an “AS IS”, “AS AVAILABLE” basis without warranties of any kind, other than warranties that are incapable of exclusion, waiver or limitation under the laws applicable to this Agreement. Without limiting the generality of the foregoing, PayMongo makes no warranty: (1) as to the content, quality or accuracy of data or information provided by PayMongo hereunder or received or transmitted using the PayMongo Services; (2) that the PayMongo Services will be uninterrupted or error-free; or (4) that any particular result or information will be obtained.
PayMongo shall not be liable for any loss, cost, compensation, damage or liability to you or third party arising from, directly or indirectly, or as a result of any or all of the following:
1. Refusal of any bank, financial institution, and the like to allow or accept transfers out of the PayMongo Virtual Account;
2. PAYMONGO E-MONEY is honored by any bank, financial institution, or other e money provider; however, the transfer transaction is not authorized, for any reason whatsoever;
3. Any delay, interruption or termination of the PayMongo Virtual Account transaction whether caused by administrative error, technical, mechanical, electrical or electronic fault or difficulty or any other reason or circumstance beyond PayMongo’s control (including but not limited to acts of God, strike, labor disputes, fire, disturbance, action of government, atmospheric conditions, lightning, interference or damage by third parties or any change in legislation);
4. Unauthorized use of the PayMongo Virtual Account (including but not limited to account takeover by third persons, or unauthorized transfers by a person given access to the PayMongo dashboard by the business owner or registered business entity) or any loss, costs, damages or payable to any third party by the PayMongo Virtual Account Holder;
5. Any misrepresentation or fraud by or misconduct of any third party.
In the event of any action that a PayMongo Virtual Account Holder may file against PayMongo Payments, Inc., the PayMongo Virtual Account Holder agrees that PayMongo’s liability shall not exceed the amount of the total Merchant Discount Rates paid by the PayMongo Merchant Account Holder to PayMongo during the last twelve (12) months from the occurrence of the event that caused the damage.
PayMongo shall have the right to automatically suspend or block a PayMongo Virtual Account in the event that it has reason to believe that the same is being used for fraudulent or suspicious transactions or by an unauthorized person. PayMongo shall not have the obligation to inform the PayMongo Virtual Account Holder prior to suspending or blocking PayMongo Virtual Account pursuant to this Section. The PayMongo Virtual Account Holder acknowledges the authority of PayMongo to suspend or block the Virtual Account and accordingly, the PayMongo Virtual Account Holder shall hold PayMongo free and harmless against any and all consequences of such suspension or blocking, or any loss or damage which the PayMongo Virtual Account Holder may suffer as a result thereof.
Without giving any reason or notice, and without prejudice to the other provision hereof, PayMongo has the absolute discretion (a) to refuse to approve any Virtual Account transaction even if there is sufficient available balance; (b) to suspend, terminate or cancel the PayMongo Virtual Account Holder’s right to use the Virtual Account; (c) to increase or decrease the balance limit; (d) to introduce, amend, vary, restrict, terminate or withdraw the benefits, services, facilities and privileges with respect to or in connection with the PayMongo Virtual Account, whether specifically relating to a PayMongo Virtual Account Holder or generally to all PayMongo Virtual Account Holders.
12.1 Data Collection
PayMongo shall keep all PayMongo Virtual Account Holder files in strictest confidence. By providing his/her information for the purpose of opening a Virtual Account, PayMongo Virtual Account Holder expressly consents to the processing of his/her supplied customer data, as may be applicable. Data belonging to the Virtual Account Holder are either Personal Information or Non-Personal Information:
a. Personal Information is any information from which the identity of an individual can be reasonably and directly ascertained, or when put together with other information would directly and certainly identify an individual. It also includes, but is not limited to, data that would help us verify:
12.2 Use of Virtual Account Holder Data
Without limiting the generality of the foregoing, the PayMongo Virtual Account Holder consents and authorizes PayMongo to store, process, disclose, exchange, and release the said information to its associates, affiliates, subsidiaries, officers, employees, agents, lawyers and other consultants, pre-paid/debit/credit bureaus or any such persons as PayMongo deems necessary, or as required by law, rule or regulation, including but not limited to:
You hereby consent to and authorize PayMongo, its subsidiaries and affiliates such as, but not limited to, PayMongo Philippines Inc., PayMongo Inc., and/or its third party partners contracted by PayMongo for the purpose of conducting its operations, including but not limited to fraud and risk management, sales and marketing activities, communications relating to their products and/or services, product and system development and innovation, customer experience management and improvement, and market research, to collect and process any and all information related thereto from whatever relevant source.
You hereby consent to and authorize the disclosure of and release by PayMongo Payments, Inc., PayMongo Philippines, Inc., PayMongo Inc. and its subsidiaries and affiliates, and PayMongo’s third party partners, of any and all information required by PayMongo Payments, Inc., PayMongo Philippines, Inc., PayMongo Inc.and/or its third party partners such as, but not limited to, the following [i] Data usage records; [ii] Customer relationship management records; [iii] Credit information; [iv] KYC data; [v] Registration data; and [vi] Transaction data.
The foregoing consents and authorizations shall continue for the duration of, and shall survive the termination of, this Agreement, or any other transactions, dealings, arrangements and accounts which you may have with, or avail from, PayMongo.
Venue of all suits shall either be at Taguig City or at any location at the exclusive option of PayMongo.
Failure, omission, or delay on the part of PayMongo to exercise its rights or remedies under these Terms and Conditions shall not operate as a waiver.
Should any term or condition in this Agreement be rendered void, illegal or unenforceable in any respect under any law, the validity, legality and enforceability of the remaining terms and conditions shall not be affected or impaired thereby.

Welcome to PayMongo Payments! Maaaring pakibasa ang sumusunod na Terms of Use (TOU) bago kumpletuhin ang pagbubukas ng inyong virtual account sa PayMongo. Ang mga sumusunod na TOU ang mga patakarang kailangang sundin sa pagbukas at paggamit ng inyong virtual account sa PayMongo website at ang mga serbisyong puwedeng gawin na kasunod nito (mula rito, tatawaging “PayMongo Services”). Sa pagbubukas at paggamit ng iyong PayMongo virtual account, tinatanggap mo at pumapayag kang sundin ang mga alituntuning nakapaloob sa TOU na ito.
Maaaring pakibasa rin muna ang aming Privacy Policy and Acceptable Use Policy bago mo gamitin ang ano mang bahagi ng PayMongo Service. Tinutukoy ng Privacy Policy kung paano namin kinokolekta at ginagamit ang inyong personal na data o impormasyon kapag ginamit mo ang PayMongo Service.
Inilalatag sa Acceptable Use Policy ang mga alituntunin na kailangan mong sundin sa iyong paggamit ng PayMongo Service. Kung hindi ka sangayon sa alin mang mga alituntuning ito sa paggamit, o di kaya’y ayaw mong sundin ang alin man dito, maaari mong itigil ang paggamit ng serbisyo.
Ang TOU na ito ay may bisa, valid, at binding sa iyo mula sa panahon na sumangayon ka dito sa pamamagitan ng pagbubukas ng inyong account, o di kaya’y sa patuloy na paggamit mo ng iyong PayMongo account, hanggang sa panahon na itigil mo ang paggamit dito, o di kaya’y i-terminate namin ito, maliban na lamang sa ibang kundisyon na kailangang manatili ayon sa batas, o sa mga regulasyon ng mga ahensiya ng gobyerno.
Inilalaan ng PayMongo ang karapatang baguhin o palitan ang TOU na ito sa ano mang oras na walang paunang abiso. Ano mang pagbabago sa TOU na ito ay effective agad kapag nai-post na sa website na ito, kasama ang kanyang bagong effective date. Kapag in-access mo o patuloy mong ginamit ang PayMongo Service pagkatapos maging epektibo ng mga pagbabago sa TOU, magiging patunay ito ng pagtanggap mo sa mga pagbabago sa TOU. Siguraduhin lamang na balikan ang pahinang ito para maging updated sa ano mang pagbabago sa TOU.
Ang pagsalin ng TOU sa Filipino at ibang dialekto ay para lamang sa convenience ng marami, at ang bersyon nito na nakalathala sa English ang masusunod pa rin kung sakaling magkaroon ng conflict ang mga naisasaad dito.
Sa ilalim ng TOU, ang mga katagang “PayMongo”, “kami”, “namin”, and “amin” ay ginagamit para tukuyin ang kumpanya ng PayMongo Payments, Inc. kasama ang mga empleyado, opisyal, mga affiliates, partners, at iba pa. Ang PayMongo Payments ay lisensiyado ng at sumusunod sa mga regulasyon ng Bangko Sentral ng Pilipinas (BSP).
1.1 Kung ikaw ang may-ari ng negosyo, inilalahad mo na ikaw ay di bababa sa edad na 18 anyos;
1.2 Kung ikaw ay kumakatawan sa isang korporasyon, sole proprietorship, partnership o iba pang uri ng negosyo, pinapatotohanan mo na ikaw ay otorisado ng mga nagmamay-ari nito na magbukas ng account para sa negosyo, at ang mga taong bibigyan ng access sa PayMongo account ay siyang otorisado rin. Pinapatotohanan mo rin na ikaw ay may kapangyarihang buksan ang account na ito para sa iyong kumpanya o negosyo, at susunod ang huli sa mga alituntuning nakasaad dito.
2.1 Sa pagtanggap mo sa TOU, binubuksan mo ang PayMongo Virtual Account na naka-link sa iyong PayMongo Merchant Account. Kailangan mong i-provide ang kumpletong impormasyon tulad ng iyong buong pangalan, kasalukuyan o permanenteng address, date of birth, nationality, pinanggagalingan ng pondo, picture at lagda alinsunod sa mga requirements ng Know-Your-Customer (“KYC”) na proseso ng BSP. Ive-verify namin ang ibinigay mong impormasyon sa pamamagitan ng hiwalay na third-party verification vendor, kung kakailanganin. Maaaring humingi pa kami ng dagdag na impormasyon, detalye o dokumento upang matulungan mabuo ang proseso ng pagve-verify.
2.2 Pumapayag ang virtual account holder na ibigay ang kinakailangang dokumento o impormasyon upang matapos namin ang verification process. Ang impormasyon, detalye o dokumentong ibibigay mo ay gagamitin sa pagsuri ng iyong applikasyon para sa PayMongo Service, o para malaman kung pupuwede mo pang ituloy ang paggamit ng iyong PayMongo Virtual Account. Inilalaan ng PayMongo ang karapatang isara, suspindehin o limitahan ang paggamit ng iyong virtual account kung sakaling hindi namin makuha ang impormasyong kinakailangan mula sa iyo. Lahat ng impormasyon, detalye at dokumentong iyong ibibigay sa PayMongo ay gagamitin lamang namin ayon sa aming Privacy Policy.
2.3 Ang virtual account holder ang responsable para sa katotohanan ng lahat ng information na ibibigay mo para sa pagbubukas ng iyong account, at siguruhing updated ang lahat ng ito. Kung sakaling may malaking pagbabago sa pagmamay-ari ng negosyo, mga produktong ibinebenta or serbisyong inaalok, obligasyon mo ring i-update ang impormasyong ito sa PayMongo. May mga karagdagang serbisyo o feature ang PayMongo na maaari lamang gamitin ng virtual account holder na nakasalalay sa pagbibigay ng karagdagang impormasyon o dokumento.
Ang mga sumusunod ay ang mga kahulugan ng mga termino or salitang madalas gamitin sa TOU:
PAYMONGO E-MONEY: isang klase ng electronic money na magagamit ng mga virtual account holder na rehistrado sa PayMongo Service upang ipadala o matanggap ang kanilang mga payouts, at mailipat ito sa bank account sa ibang bangko o iba pang e-wallets.
PayMongo Service: ang tawag sa kabuuan ng mga serbisyo na available sa website ng PayMongo, kung saan ang isang PayMongo Merchant ay puwedeng gamitin ang kanyang account para tumanggap ng bayad mula sa kanyang mga buyer, customer o kliyente, at kung saan puwedeng gamitin ang PayMongo Virtual Account.
PayMongo Virtual Account: ang tawag sa instrumento ng e-money na humahawak ng kaukulang halaga ng Philippine Peso (Php) sa loob ng PayMongo system. Nakadikit ang Virtual Account na ito sa aprubado at aktibong PayMongo Merchant account. Ilan sa mga bagay na iyong magagawa gamit ang isang PayMongo Virtual Account: Makatanggap ng payout, maglipat ng pondo, at balance inquiry.
PayMongo Virtual Account Holder ang tawag sa isang negosyo or may-ari ng negosyo na nagrehistro para sa pagbukas ng PayMongo Virtual Account upang matanggap niya rito ang kanyang mga payout mula sa paggamit ng online facilitation services ng PayMongo.
“Know Your Customer” or “KYC” ang prosesong iminandato ng Bangko Sentral ng Pilipinas upang makilala at matiyak ang pagkatao at negosyo ng isang nag-aapply para magbukas ng PayMongo Virtual Account.
Ang PayMongo Virtual Account ay isang reloadable na e-money instrument. Hindi ito deposit o savings account, at ang nilalaman nito ay hindi sakop ng Philippine Deposit Insurance Corporation (PDIC). Hindi rin ito maaaring kumita ng anong interes. Ang PayMongo Payments, Inc, bilang issuer ng e-money instrument, ay direktang responsable sa mga PayMongo Virtual Account holders para dito.
Gayunpaman, sakop ito ng mga regulasyon ng BSP, ng Anti-Money Laundering Act (AMLA) at ng mga sumusunod nitong pagamyenda, kasama ang Data Privacy Act ng 2012 at ang kaagapay na Implementing Rules and Regulations. Ang halaga o value na niload sa isang PayMongo Virtual Account ay maaaring gamitin upang mag-transfer o maglipat ng pera sa account sa ibang bangko o e-wallet account.
Maaaring magpataw ng limitasyon sa halaga ng Transaction at balanse sa iyong PayMongo Virtual Account ayon sa mga batas at regulasyon pagkatapos magkaroon ng paunang pasabi o anunsiyo ang PayMongo sa mga customer na di iikli sa labinlimang (15) araw bago ang implementasyon ng nasabing limitasyon.
Pumapayag ang PayMongo Virtual Account Holder na bayaran ang ibang fees at charges para sa kanyang mga transfer ng pera palabas ng kanyang PayMongo Virtual Account. Kasama na ang mga kaukulang buwis o tax sa transfer fee, na siyang iaawas agad mula sa balanse ng inyong PayMongo Virtual Account.
Ang mga dormant o di nagagamit sa loob ng anim (6) na buwan na PayMongo Virtual Account ay mapapatawan ng dormancy maintenance fees, na sisimulang bilangin mula sa araw ng huling transaksyon nito.
Ang transaction history (ang pagpasok ng load at pag-transfer nito palabas) ng isang PayMongo Virtual Account Holder ay maaaring makita sa pamamagitan ng pag log-in sa inyong PayMongo Merchant Dashboard sa PayMongo Website. Maaari ring i-download at i-print ang transaction history mula rito.
Ang mga entry sa inyong PayMongo Virtual Account transaction history ay ipinapalagay na totoo at tama, maliban lamang kung magpadala ng pormal na abiso ang PayMongo Virtual Account Holder sa PayMongo Payments, Inc. sa loob ng labinlimang (15) araw mula sa petsa ng sinasabing transaksyon. Kung walang dispute o pagtutol ang natanggap sa loob ng labinlimang (15) araw, ang mga transakyon at entry sa Account/ Transaction History sa Dashboard ay makatotohanan at otorisado ng PayMongo Virtual Account Holder.
Ang mga Disputed o tinutulang transaksyon ay makekredito lamang sa balanse ng isang PayMongo Virtual Account Holder kapag naproseso, naimbestigahan, at napatunayang tama.
Walang binibigay na garantiya ang PayMongo, hayag man o di hayag, ukol sa PayMongo Service; ito ay inaalok bilang “AS IS,” “AS AVAILABLE” na walang garantiya, maliban na lamang sa mga garantiya na nakamandato sa ilalim ng batas.
Hindi ginarantiya ng PayMongo ang mga sumusunod: (1) ang nilalaman, kalidad o katiyakan ng datos o impormasyon na ipinadala o natanggap gamit ang PayMongo Services; (2) na walang magiging interupsyon sa PayMongo Services o di kaya’y error free ito; or (4) na may partikular na resulta o impormasyon ang makakamit.
Walang pananagutan ang PayMongo para sa kahit anong kawalan, kumpensasyon, o pinsala sa iyo o sa kahit sinong maituturing na third party sa kadahilanan ng mga sumusunod:
1. Pagtanggi ng kahit anong bangko, o financial institution, and ng mga katulad na institusyon na tanggapin ang mga transfers mula sa isang PayMongo Virtual Account;
2. Sa sitwasyong tinanggap ang PAYMONGO E-MONEY ng kahit anong bangko, financial institution, o ibang e-money provider; ngunit lumabas na hindi otorisado ang transaksyon, sa kung ano mang dahilan;
3. Anumang pagkakaantala, interupsyon, o di pagtuloy ng transaksyon ng PayMongo Virtual Account maging resulta man ng administrative error,technical, mechanical, electrical o electronic fault or difficulty o ano pa mang dahilang wala sa kontrol ng PayMongo (kasama ngunit hindi limitado sa mga sumusunod: Acts of God, strike, labor disputes, sunog, riot, aksyon o utos pamahalaan, atmospheric conditions, lightning, interference o pinsala mula thirdparties o kahit anong pagbabago sa batas);
4. Hindi otorisadong paggamit ng PayMongo Virtual Account (kasama, ngunit hindi limitado sa sumusunod: “account takeover” or hindi otorisadong pagkontrol ng Virtual Account ng mga third persons, o di otorisadong transfers na ginawa ng isang taong binigyan ng access sa PayMongo dashboard ng may-ari ng negosyo, o kahit na anong kawalan, asunto, pinsala o halagang dapat bayaran sa isang third party ng PayMongo Virtual Account Holder;
5. Anumang maling paglalarawan o deklarasyon (misrepresentation) o panloloko (fraud) o maling pag-uugali (misconduct) na gawa ng kahit na sinong third party.
Sakaling magkaroon ng reklamo o asuntong isinampa ang PayMongo Virtual Account Holder laban sa PayMongo Payments, Inc, sumasangayon ang PayMongo Virtual Account Holder na ang pananagutan ng PayMongo ay hindi lalampas sa kabuuang halaga ng Merchant Discount Rates na binayaran ng PayMongo Merchant Account Holder sa PayMongo sa huling labindalawang (12) buwan bago mangyari ang insidenteng sinasabing nakapinsala.
Karapatan ng PayMongo na awtomatikong suspindehin o i-block ang isang PayMongo Virtual Account kung may dahilan itong maniwala na ito ay ginagamit para sa mga mapanlinlang (fraudulent) na transaksyon o ng isang hindi otorisadong tao. Walang obligasyon ang PayMongo na ipagbigay alam sa PayMongo Virtual Account Holder and suspensyon o blocking ng naturang PayMongo Virtual Account sa ilalim ng regulasyong ito. Kinikilala ng PayMongo Virtual Account Holder ang karapatan ng PayMongo na suspindihin o i-block ang Virtual Account, at tinatanggap nitong walang pananagutan ang PayMongo sa anumang kawalan o pinsalamg maaaring mangyari mula sa suspensiyon o blocking.
Sakaling magpasya ang PayMongo na gawin ang sumusunod, hindi kailangan magbigay ng dahilan o abiso ng PayMongo kapag: (a) tumanggi itong aprubahan ang isang transakyon kahit may sapat na available balance o laman ang PayMongo Virtual Account; (b) suspindihin, kanselahin o itigil ang paggamit ng PayMongo Virtual Account; (c )taasan o bawasan ang balance limit; (d) maglagay, magamyenda, palitan, magpalit o bawiin ang anumang benepisyo, serbisyo, pasilidad o pribilehiyo ukol o konektado sa PayMongo Virtual Account, kaugnay sa isang partikular na PayMongo Virtual Account Holder o sa lahat ng klase ng PayMongo Virtual Account Holder.
12.1 Koleksyon ng Personal mong Datos at Impormasyon
Striktong sinusunod ng PayMongo ang lahat ng batas at alituntunin ukol sa tamang koleksyon, pagaalaga, at pagtatago ng lahat ng personal na datos at impormasyon na ibinigay sa amin ng aming mga PayMongo Virtual Account Holder. Sa pagbibigay o pagsusubmit ng iyong personal na detalye, impormasyon, at dokumento, pinapayagan mo ang PayMongo na iproseso ang inyong binigay na datos at impormasyon para sa mga gamit na nakasaad sa TOU.
Ang datos na pagmamayari ng Virtual Account Holder ay nakakategorya bilang Personal Information o Non-Personal Information:
a. Ang Personal Information ay kahit anong impormasyon kung saan direktang matutukoy ang pagkatao o pagkakakilanlan ng isang indibidwal; o impormasyon kung saan, kapag pinagsama-sama ay direktang matutukoy ang isang tao o indibidwal. Kasama rito ang mga detalye na tutulong sa aming tukuyin ang mga sumusunod:
12.2 Paggamit ng Datos ng Virtual Account Holder (Use of Virtual Account Holder Data)
Walang intensiyong limitahan ang kabuuan ng sumusunod, pumapayag at binibigyang pahintulot ng PayMongo Virtual Account Holder ang PayMongo na itago, iproseso, ibigay, at i-release ang kanyang impormasyon sa mga associates, affiliates, subsidiaries, opisyal, empleyado, ahente, abogado at iba pang consultants, pre-paid/debit/credit bureaus o iba pang tao na, sa paningin ng PayMongo ay kailangan makaalam, o di kaya’y nakasaad sa batas, alituntunin o regulasyon sa mga sumusunod na sitwasyon:
Pinapahintulutan mo ang PayMongo, ang mga sangay, affiliate tulad ng, ngunit hindi limitado sa, PayMongo Philippines Inc., PayMongo Inc., mga third party partners na kinontrata ng PayMongo para gawin ang kanilang operations, katulad ng fraud at risk management, sales at marketing, promotion ng kanilang mga produkto o serbisyo, product at system development at innovation, customer experience management at improvement, market research, at pagkolekta at pagproseso ng impormasyon kaugnay nito.
Pinahihintulutan mo ang paghahayag (disclosure) at pagbabahagi (sharing) ng PayMongo Payments, Inc., PayMongo Philippines, Inc., PayMongo Inc. at ng mga sangay at ibang bahagi nito, kasama ang mga third party partners, ng kahit anong impormasyon ang kailangan ng PayMongo Payments, Inc., PayMongo Philippines, Inc., PayMongo Inc.and/or its third party partners tulad ng: [i] Rekord ng Data usage; [ii] Rekord ng Customer relationship management; [iii] Credit information; [iv] datos mula sa KYC data; [v] datos tungkol sa iyong pagrehistro; at [vi] datos ng transaksyon.
Ang mga pahintulot na binigay dito ay may bisa sa kabuuan ng kasunduang ito, at may mga bahaging maaaring may bisa pa kahit makansela na ang kasunduan.
Ang venue ng lahat ng paglilitis na maaaring lumabas mula sa TOU ay pupuwede lamang sa Taguig City o kung saan pa mang hurisdiksyon sa loob ng Pilipinas, sa eksklusibong pagtukoy ng PayMongo.
Anumang pagkukulang, pagantala, o pagkaligta ng PayMongo ukol sa mga karapatan nito sa ilalim ng TOU ay hindi maituturing na waiver ng aming karapatan.
Kung sakaling may bahagi o parte ng TOU na ideklarang walang bisa, ilegal, o hindi maipapatupad dahil sa batas, hindi maaapektuhan ang ibang bahagi na walang kinalaman o hindi nasasakupan ng nasabing bahagi.
Sumasangayon ang PayMongo sa pagpapatupad ng mataas na standard ng financial consumer protection para sa aming mga Virtual Account Holder. Priority namin ang inyong mga reklamo, komento, at mga suhestiyon kung papaano pa namin mapapaganda ang aming serbisyo para sa inyo.
Kung sakaling mayroon kang concern o suhestiyon na gustong mong idulog, o di kaya’y kailangan ng tulong tungkol sa iyong account, maaaring magpadala lamang ng mensahe sa aming mga customer success channels. Ang impormasyon na iyong ibibigay ay strictly confidential at nangangako kaming susubukan ang aming makakaya upang matulungan kang maresolba ang isyu.
